We wont allow you to create problem for FAYOSE

Peoples Democratic Party, PDP, in Ekiti State has dragged the All Progressives Congress APC state government to court over planned creation of additional 18 Local Government Development Areas LCDAs, in the state, alleging violation of the provisions of the 1999 constitution.

The party is asking the court to compel the state House of Assembly to stop any further action on the issue.


In the suit number HAD/75/2014 filed at the High Court of Justice, Ado Ekiti Judicial Division on July 1, 2014, deposed to by the PDP Chairman in the state, Mr Makanjuola Ogundipe on behalf of the party , PDP described the government’s action as illegal and unconstitutional.

Joined in the suit are: Governor Fayemi (1st defendant), Attorney General and Commissioner for Justice, Mr Wale Fapohunda (2nd defendant) and the Ekiti State House of Assembly (3rd defendant).

The party is seeking for “a declaration that it is an exercise in futility for the 1st defendant to embark on the creation of Local Governments or LCDAs at the twilight of his tenure, being a process that cannot be completed before the expiration of his tenure but meant to cause confusion for the incoming government.

A declaration that any Local Government or LCDAs created by Dr Fayemi in contravention of the 1999 constitution as amended is null, void and of no effect.

PDP as party therefore seeking for a perpetual injunction restraining the defendants from

embarking on further process towards the creation of additional Council.

PDP is equally seeking for a perpetual injunction restraining the 3rd defendant, Ekiti State House of Assembly from receiving and or considering any process forward to it by the Governor.

Aside the foregoing, the PDP asked court to determine “whether Governor Fayemi can validly create Local Governments or LCDAs in contravention of Section (3) of the 1999 constitution .

Whether the Governor has the power under the 1999 constitution to abolish Local Government Areas created under the 1999 constitution by altering their names, adjusting their boundaries and dividing them into smaller units. Whether Governor Fayemi has the power to exhibit such power without recourse to the National Assembly.”

No date has been communicated to the parties for the hearing of the case.

Meanwhile, PDP has warned civil servants in the state against colluding with the out-going All Progressives Congress, APC-led government in looting the state’s treasury or illegal employment

A statement issued in Ado Ekiti by the Publicity Secretary of the party, Pastor Kola Oluwawole, claimed it had discovered that Fayemi’s government had been taken a lot of steps that would backfire since he lost election few days ago.

Oluwawole revealed that Dr Fayemi has held a meeting with some top civil servants on Thursday where he allegedly directed the civil servants to come up with a supplementary budget to organize local government election scheduled for end of this month

The party, however, warned that any civil servants found to have assisted Fayemi to loot the state treasury or illegal employment which he said were backdated would face a disciplinary action when the new government is inaugurated.

According to him N184, 863,211.19, N406, 293,791.08 and another N604 million were collected within a day for the purchase of furniture that would be used at the new government

It was equally alleged that the governor made an approval of 1.9 Billion Naira for the procurement of medical equipment for Oba Rufus Adejugbe General Hospital Ado Ekiti, all within one week.

“We equally gathered that the government is planning to plunge Ekiti State into another round of bond chasing because of the intention of the outgoing Governor and his men to milk Ekiti dry before leaving the government in October.”

Reacting to the development, Commissioner for Information and Civic Orientation, Mr Tayo Ekundayo, expressed dismay that PDP could be issuing directives when the present administration still had more than three months tenure

“As a party and government, we have tenure which is going to lapse till 16 October 2014. Whatever we do within the period has legitimacy. Therefore, for anybody to issue directives to civil servants is arrant nonsense. I can assure you, there is nothing illegal that Fayemi will do before his tenure lapses. He is a lover of democracy and rule of law,” Ekundayo said.
